1. Acceptance of Terms
By accessing, interacting with, or utilizing any assets or services operated by krypton Innovations; including, but not limited to, our websites, software, and Discord servers, you expressly agree that these Terms of Service ("TOS") constitute a binding legal agreement. Any failure to comply with these terms will result in restriction from utilizing our services.
2. Compliance
2.1 Zero-Tolerance Policy: krypton Innovations holds a strict zero-tolerance policy for:
- Harassment, hate speech, bullying, or targeted toxicity against any individual or demographic
- Content that is not safe for work, or otherwise inappropriate
- The propagation of malicious, defamatory, or intentionally disruptive content
- Exploitation or manipulation of our services (e.g., bypassing security features)
Violations of this policy will result in restriction from utilizing our services. Such restrictions may be permanent, and reinstatement, if considered, is at the sole discretion of krypton Innovations.
2.2 Respecting Platform Terms: Users are not only bound by the krypton Innovations' Terms of Service, but also by the terms of any third-party platforms utilized by krypton Innovations where applicable. These third-party terms will be accessible through the respective platform's website.
3. Intellectual Property
All source code, confidential information, and content developed by or under krypton Innovations remain the exclusive intellectual property of krypton Innovations unless clearly stated in writing. Unauthorized redistribution, modification, or resale of these assets is strictly prohibited.
4. Commission Modifications
Clients retain the right to access and modify the commissioned software provided to them. Where such software is hosted by krypton Innovations, clients are not permitted to access any environment variables, credentials, or underlying infrastructure, including but not limited to API keys, tokens, server-side configuration, or other confidential data.
Unless otherwise authorised in writing by krypton Innovations Management, commissioned software, whether hosted by krypton Innovations or self-hosted by the client, may not be redistributed, sublicensed, sold, or otherwise provided to any third party.
5. Data & Privacy
krypton Innovations does not independently collect or process personal data. Any data generated through User interaction is collected and managed exclusively by the respective third-party platforms hosting such interactions. Save for exceptional technical or operational needs requiring the temporary processing of basic identifiers, it is our policy that your personal data is neither obtained nor retained by krypton Innovations.
6. Disclaimer of Warranty
All software, bots, and services provided by krypton Innovations are offered on a free basis and are supplied "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. krypton Innovations does not guarantee uninterrupted, or error-free operation of any service.
7. Limitation of Liability
To the maximum extent permitted by law, krypton Innovations shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, profits, or business opportunities, arising from the use of, or inability to use, our services.
8. Termination
krypton Innovations reserves the right to suspend or terminate a User's access to its services, with or without prior notice, for any breach of these Terms or appropriate rules per platform.
9. Changes to These Terms
These Terms may be updated from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms. The "Last updated" date above reflects the most recent revision.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of England and Wales.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
